Future Of Mesothlioma Claims Under The Legal Aid, Sentencing and Punishment of Offenders Bill

By Daren Bach

The process of successfully holding a former employer and / or their insurers to account by an asbestosis lawyer for determining lawful liability for a claimant's mesothelioma or related asbestos disease and /or asbestosis symptoms, such as pleural plaques, can be lengthy and complicated and subject to different rulings at different times.

One recent example is the reinstatement - first in Scotland and then in Ireland - of the ability to make a mesothelioma for the presence of pleural plaques (raised fibrous scarring of the lungs) in late 2011, just four years after the House of Lords ruled that individuals with the confirmed condition would no longer receive compensation.

Now the process is to be subject to financial cutbacks, which would actually leave those claimants ( or more likely, their surviving spouses / family members) who win their mesothelioma claim with damages reduced to below current figures.

Concern over the cost of civil justice in England and Wales, particularly in certain cases when the costs were often disproportionate to the issues involved led to The Review of Civil Litigation Costs - or Jackson Review - in 2009. The Legal Aid, Sentencing and Punishment of Offenders Bill currently being discussed in Parliament, draws upon the recommendations of the Jackson Review, which could see a maximum claimable success fee, widely expected to be 25 per cent of the damages awarded.

The Jackson Review also include the following proposals:

The costs system should be based on legal expenses that reflect the nature/complexity of the case. Success fees and after the event insurance premiums should not be recoverable in no win, no fee cases. General damages awards for personal injuries and other civil wrongs should be increased by 10%. Claimants should only make a small contribution to defendant costs if a claim is unsuccessful (if behaviour is reasonable).

Under the above proposal, it is recommended that all future fees for a successful claim be paid out of the claimant's damages and not by the losing defendant. However, to offset the more adverse affects from the above change, a general damages award for 'pain, suffering and loss of amenity' is to rise by 10 per cent.

At present, and according to the 2010 publication of the JSB Guidelines 10th edition, the range of mesothelioma award payments was amended from the 9th edition figures of

Common Symptoms of Cancer

Similar to other diseases, cancer can show symptoms that vary from one person to another. The symptoms of cancer depend on the location, the size and the other areas to where the cancer has spread. However, sometimes cancers such as lung cancer do not show any symptoms in its early stages. The symptoms of cancer only become clear in its final stage, resulting in a prognosis than is not necessarily good. This is why many people are very shocked knowing that they are diagnosed with final stage of cancer given that they did not have any symptoms earlier.

Nevertheless, there are some that you can watch out for. Unexplained weight loss is one of the symptoms, although it might also be a symptom of other conditions such as diabetes or depression. However, if you suddenly experience this symptom, it is recommended to see a doctor to find out the cause. Losing a significant amount of weight can possibly be a symptom of lung, stomach or pancreas cancer. Another common symptom is fatigue. The same as with weight loss, fatigue is often associated with other conditions such as infectious or metabolic disorders. However, if you experience severe exhaustion that persists even though you have taken bed rest, it can be an indication of cancer too. Fever is also one symptom of cancer and prolonged fever can be a clear indication that the cancer cells have spread to other areas of the body. Fever can also be an indication of the immune system that is affected by the cancer, such as in leukemia. If you experience either fatigue and fever or both, especially if they persist, getting medical assistance and an examination is highly recommended. Those three are the result of the cancer cells that also need nutrition to live, and therefore the cells consume your body's energy supply. Certain substances of the cancer are also able to change how the body absorbs energy from the food it consumes. The symptoms can also be the outcome of how your immune system fights the cancer cells.

In addition to all the above, persistent and prolonged pain in some part of the body can also be a sign of cancer. A very common pain that people have is headache, which most of the times is associated with other conditions. However, if you experience prolonged and sharp headaches and the pain increases when you tip your head forward, as well as experience with memory loss, it might be a sign of cancer such as a brain tumor. Back pain can also be a sign of cancer including lung cancer. Another symptom that is more obvious is skin changes. For instance, liver cancer often causes yellowish skin and eyes; breast cancer causes reddened, itchy and extracted skin around the breast and so on.

Knowing the most common symptoms of cancer and checking yourself at the doctor if any of those symptoms exist is important. By doing so, cancer can be found earlier and the survival rate will be higher.

Stage 4 Lung Cancer Life Expectancy and Treatments

Stage 4 lung cancer is the last stage of lung cancer that is also known as Metastatic Cancer. This is the condition where the cancer cells have affected both lungs and other areas of the body, such as brain, bones, liver and so on. Unfortunately, 40 percent of people diagnosed with lung cancer are already in stage 4 when they are first diagnosed. This is not uncommon as earlier stages often misidentified as other less serious health problems. Thanks to medical improvements, a diagnosis of stage 4 lung cancer does not mean that they cannot prolong their life. The life expectancy of the patient can be improved through certain treatments so the patients can live longer, generally about 7 to 12 months since they are diagnosed, although the cancer itself is incurable. Some people are even able to survive for years, even up to 7 years.

The life expectancy of stage 4 lung cancer therefore varies, depending on many factors, including the physical and mental condition of the patient, the age, the sex, and the current condition of the cancer itself, whether it has developed further or not. Normally, women have higher survival rate than men. In this stage, surgery is no longer possible and chemotherapy is the option to reduce the size of the tumor, slow its growth, terminate the most cancerous cells, improve the symptoms and quality of life and more importantly, prolong the life of the patients. Radiation is often mixed with the chemotherapy. Both methods often cause severe side effects such as abdominal pain, memory loss, bone pain, kidney problems, impotence and many others. In addition, there are other treatments that can help the patient prolong their life, which are target drug treatment and the patient's contribution in clinical experiment. Both methods basically work by targeting the patient's cancer characteristics and treating it. The patients will not experience severe side effects as with chemotherapy and radiation. The medical experiment alone is proven to be successful in improving the survival rate of the patients, mainly because patients engaging in the experiment get all the focus on themselves and if there is a new finding to help improve the survival rate, it will be tested on them. In addition to all the medical treatments above, sometimes patients also look into alternative treatments, although from medical point of view, those treatments do not do the stage 4 lung cancer anything. The treatments include acupuncture, massage therapy, certain diet, natural substances such as baking soda and even taking kerosene as well as certain herbal remedies. They might work in reducing the symptoms of the cancer but are unlikely to cure the cancer itself, but are always worth investigating, as some have a very good history of helping. The outcome of those alternative treatments is always better if the cancer is still in early stages.

By knowing the life expectancy and treatments of stage 4 lung cancer, patients can be more prepared for what they will be going through and their loved ones are also ready to support them throughout the whole process.

Life expectancy and treatment of stage 4 lung cancer is very important information for patients to know about. By taking the treatments, the life expectancy and the quality of life can be improved.

What Is The Latest Mesothelioma Disease Information?

By Kevin Wynn

One of the most aggressive cancers of the last century is also the one least known about in the public eye. Mesothelioma disease information was the least talked about, especially when it came to public news about dangers of asbestos. Strides towards ending this cancer were accomplished when the substance that causes it, asbestos, was removed, by law, from many of the same places that workers were exposed to it, like factories and shipyards, and its use in construction became outlawed. It was not until a number of workers in the mines where it was cultivated came down with the cancer than more information was finally released to the public.

What Is Mesothelioma?

Now that the world has learned more Mesothelioma disease information, some basic facts have become known about this very aggressive form of cancer. It is chiefly caused by exposure to asbestos, a naturally occurring mineral mined throughout the Southwest, and the victims most likely to develop it were construction workers, miners, and industrial workers that created the insulation used in construction and other industries.

Mesothelioma disease information also revealed that this cancer is primarily found in the lining of the lungs, heart and abdomen. Pleural Mesothelioma, where the asbestos fibers have lodged themselves within the very liner that allows the lungs their free movement during breathing, is the most common. Pericardial Mesothelioma is more rare, when asbestos fibers have found their way into the pericardium, the membrane around the heart. Peritoneal Mesothelioma, is also rare, and occurs when the asbestos finds its way to the stomach lining.

Symptoms And Treatment

The symptoms associated with Pleural Mesothelioma, the most common form according to Mesothelioma disease information, begins with shortness of breath, an extraordinary buildup of fluid within the lungs, and chronic hoarseness. By the time this cancer is diagnosed, the victim is also experiencing chronic coughing, with blood, muscle weakness and chest pain. Final stages include sensory loss, paralysis and swelling in the face and arms. All too often companies claimed that their workers were affected by it because they also smoked, causing the fibers to be inhaled in that manner, and ineligible for compensation through attorneys and law firms.

The treatment options available for this common form, according to Mesothelioma disease information, will require several surgeries to complete. The first surgery often performed by doctors at clinics and treatment centers is a pleurectomy decortication, removing part of the lung lining in order to remove any tumors. If the tumors continue to appear, a second surgery, a extrapleural pneumonectomy, removing up to one lung, in order to get all of the tumors out of the body.

Laws And Litigation

According to Mesothelioma disease information, because the symptoms are so similar to a host of other diseases, the fact that it is cancer is often found too late for effective treatment. This has led to many lawsuits filed by lawyers against the companies responsible, and to many states creating laws to limit litigation and compensation as a result.

Mesothelioma Treatment Options And What To Expect

If you or somebody that you know has come down with this particularly fatal form of cancer and are wondering what your mesothelioma treatment options are, you might find the following information helpful. The problem that confronts so many patients and doctors when attempting to treat mesothelioma; is that in most cases, it is not diagnosed in the early stages of its development.

The reason for this is that it is very rare and the physicians only start testing for it after they have exhausted all of the treatment options for the symptoms that their patient is complaining about. Mesothelioma cancer only develops after a person has been exposed to a very harmful material, called asbestos.

If you believe that you have been exposed to asbestos, you need to schedule an appointment with your doctor immediately and let them know that you came in contact with this substance. In addition, depending on the amount of exposure that you experienced, it could take years, or even decades for mesothelioma cancer to first appear.

Therefore, it is recommended that you see your doctor each and every year and have them test for it. When it is caught very early, your chances of survival are much greater than in the later stages of its development.

There are a few mesothelioma treatment options that are available today, and the one that your physician selects will be based on a number of factors. Some of them are the following; the location of the tumor and the kind of mesothelioma cancer that you have, how much the cancer has spread throughout your body, how large the tumor is, how old the patient is, the general health of the patient, and whether the cancer is in stage I,II, or III.

Depending on the above factors your doctor could recommend surgery, chemotherapy, radiation therapy, palliative therapies, or a combination of any or all of the above. Most if not all patients with mesothelioma cancer will need to see the following types of doctors, radiologist, pulmonologist (lung specialist), and oncologist (cancer specialist).

Only in very rare cases will a doctor be able to significantly extend the life of a patient that has stage III mesothelioma cancer. In most instances all they can do to improve the quality of the individual's life, is by reducing the pain that the person is experiencing.

There are certain professions that are much more likely to catch mesothelioma cancer than others, and they are plumbers, electricians, construction workers, and maintenance men. The reason for this is that asbestos was widely used as a construction material in the 20th century. In addition, if somebody that you know has contracted the disease and you frequent the same structures as they do, your odds of also coming down with it are much greater.

If you suspect that you have this form of cancer, you should see your physician immediately, and let them determine the best mesothelioma treatment options for your particular case. You should never put off going to your doctor for even one day, if you believe you have this disease.

Mesothelioma Treatment Works Best When The Cancer Is In Its Early Stages Of Development

As with most diseases, and mesothelioma cancer is no different, the sooner you know that you have it, the better your chances of surviving it. Unfortunately, today there are virtually no known mesothelioma treatment options that can save your life if the cancer has already spread throughout your body.

Mesothelioma cancer is a very rare form of this group of deadly diseases. Most general practitioners are ill-equipped to even diagnose it. In fact, if one of their patients happens to catch it, more than likely it is the first time that they will have ever seen a person with this disease in their entire professional career.

This is one of the reasons that it is so fatal, because your doctor will usually treat you for the symptoms that you are experiencing that are very similar to all kinds of other diseases. It is only after they have exhausted all of their other options, will they suspect that you have mesothelioma cancer.

If you happen to be wondering how somebody catches this disease, you can only get it by coming in contact with a lethal material, called asbestos. Years ago, asbestos was used to make all kinds of products. It was very popular at the time, and it was thought of as a gift to mankind because it possessed so many sensational properties.

Thankfully, most of those items are no longer with us. However, it was also heavily used as a construction material, and it is still in many old buildings constructed during the 20th century. Almost assuredly, if somebody catches mesothelioma cancer today, they came in contact with it in a structure that was built during this time frame.

There are only a very few mesothelioma treatment options that are available today, and none of them are very pleasant or effective. They are in no particular order; chemotherapy, surgery, radiation therapy, and palliative therapies.

When the tests are done that confirm that you have mesothelioma cancer, your family doctor will then send to you see a oncologist. An oncologist is a cancer specialist that will review your file, and more than likely recommend that more medical test are done in an attempt to determine how far the cancer has advanced.

If these tests reveal that it has spread throughout your body, there is very little that can be done for you at that point, except to provide you medication that will relieve some of the pain that you are experiencing. Depending on what type you have, where it is located, and how large the tumor is, will determine what your best treatment alternatives are.

Mesothelioma cancer is no joke, and only a very few people that ever come down with it, survive to tell their story. If you suspect that you might have it, you should certainly see your doctor immediately and get tests done to confirm or deny it. The most successful mesothelioma treatment options are the ones that are utilized when the disease is in its very early stages of development.

Unfortunately for most patients that come down with mesothelioma cancer, it usually is only discovered, when it is far too late for any type of effective treatment. There are many reasons for this, and one of them is that it is very rare, and in most cases a doctor will not think that you have it.

It will only be after the first few treatments failed to help you feel better, will mesothelioma cancer be tested for. This cancer is caused by coming in contact with a material called asbestos. It can sit in a person's body for many years, or even for many decades before it starts to develop.

If at any time in your life you have come in contact with asbestos, you should be tested for mesothelioma cancer once a year. Asbestos today is mainly found in old buildings. It was widely used as a building material during the 20th century.

It was used in the cement to make it stronger, it was used to cover water heaters because of its instillation properties, and it was used to cover electrical cable because it was inexpensive.

Many times it can stay in a building for a very long period, because nobody suspects that it is there. Today, there is an industry of specially trained companies that renovate buildings where it is present, and totally remove it. When one of these company's comes to a building, all of its occupants must look for some place else to either work or live.

If somebody that you know has contracted mesothelioma cancer and you either live or work in the same building as they do, you are now in a very high risk group of also coming down with it. The very first thing that you should do is go to your doctor, let them know that somebody who frequents a building that you do has got mesothelioma cancer. You should also ask them to test for it right away.

If your test comes back negative, you should request that your building be inspected by either the Environmental Protection Agency (EPA), or your local building inspector for asbestos. Mesothelioma cancer is not something that you want to mess around with.
